Whether credit card non payment if the customer wants to file a case whether it will come in civil or consumer case plz verify

Dear Sir / Madam,
In a credit card non payment and settlement of dues legal case filed by the customer, it is prima facie a consumer case. But the jury decides the course of action. It is initially treated as a civil complaint lodged in Court, but may also turn into criminal when Police proceedings are initiated by the lending Bank against the customer.
