Legal Question in Banking Law in India

Sir,

My self is ashok and I deposited one cheque in bank for incashment but due to collection bank clerk�s mistake they have credited it in wrong account depite providing accurate information from my side over slip and cheque.

In this case I was the drawee and drawer ( I was transferring money from my one account to other) so I have went in both of the banks and tried to know about this

Amount has been debited from my account at drawee bank in the favour of some other name which I never mentioned over cheque or slip I have the rest part of the slip .

But on the other hand side I have not recd. The credit in my account at drawer bank so it means that drawer bank is in fault and due to their mistake I am suffering .

So kindly suggest that what to do shall I go in to consumer court because it has been more than ten days to me going in bank but they people are really sleeping they are not much bothered about my problem .

As per their local chq. Collection policy it was to be cleared within 3days but it has not been yet and kindly suggest how to take the cheque copy from bank through rti.

And which bank should I file rti at drawer bank or drawee bank . kindly help amount is big but they people are really careless�.

Issue notice to both the banks to restore the correct credit with I interest and compensation of Rs.1000/- for mental agony, correspondence etc, within a week with copy to the chairman of both the banks. If u do not get proper redress, complain to Banking Ombudsman. U can find out the procedure by accessing the RBI website
