Legal Question in Business Law in Nigeria

In March 2013, I sent out a proposal /bid in response to invitation to submit proposal to African Development Bank, Tunis, Tunisia, Africa through an international courier company. I tracked the document's movement via the company's website. The document arrived Tunisia on Thursday morning 10.30 AM while the deadline for submission was 17.00PM Friday the following day. I had emailed a senior management staff who is a friend and former secondary school classmate to ensure its delivery before the deadline. The company did not deliver. There was no public holiday nor any crisis in Tunis that could prevent delivery. I complained on the following Monday and they delivered on Tuesday. It was late and African Development Bank rejected and returned the document. So we lost an opportunity to advise the Bank on one of its operations - financial support to sub-national public sector. If we got the consultancy we would have have opportunity to meet all members countries' Finance Ministers and Central Bank Governors which would have broadened our business visibility.

I complained to the courier company's customer service via email. The head acknowledged that it was a service failure, promised to investigate. However the company has not responded to my several requests to let me know the outcome of its investigations.

Two years have already gone by this episode and you are waking up now. "Better late than never". In Africa, the weekend begins on Thursday evening itself, with Africans playing soccer with their office colleagues and friends on Fridays and Saturdays, and spending time with their family and attending social gatherings and functions on Sundays.You should check what does your senior management friend have to say on this "goof up". Your compensation claim from the courier company should be at least 100 times the amount you paid the courier company for the parcel. So if you paid Naira 50/- (Naira Fifty Only) for the parcel, your compensation claim should be minimum Naira 5,000/- (Naira Five Thousand Only).
