I had filed civil suit in rajasthan on one person who had illegaly encroached my plot nd constructed house the cse is in intial stage i want to know till the case is going on can i get such order thorough the said property gets restricted from use neither by me or him . if this is possible what is called such order so that i can tell.my.advocate for same . also pls tell me how much time it takes such case to finalise.

Dear Sir / Madam,

Your going to the Court to get a "restraint order" may be a lengthy process, which will work to the advantage of the illegal encroacher as he will continue to illegally occupy the house.

Instead, for speedy action, you should immediately lodge an FIR in the local Police Station for "illegal trespass" into your property and inform the local Municipality, and thereafter, straightaway get an overnight demolition of the unauthorized structure done. Let the illegal encroacher then approach the Court.
