Legal Question in Civil Rights Law in India

We took a project for Rs 2.5 lacs from data entry vendor we have 12 months agreement with them and they have some benchmark for the quality, we are waiting for our second month quality but now our vendor is saying that their end client is not traceable so if you score in quality parameters we will do the payment but we cannot say afterwards so are we in a position to file a legal suite against them and in which category one more thing in the agreement they mentioned that they are the end client,the vendor is saying that we are not in a position to compensate as we are also filling a legal suit against the end client so even if you file a case against it wont prolong in the eyes of law as we are already registering the case so we are not at fault.the vendor is saying that we are not in a position to compensate as we are also filling a legal suit against the end client so even if you file a case against it wont prolong in the eyes of law as we are already registering the case so we are not at fault

if the vendor is filing the civil suit against the end client he will not seek a remedy for you he will recover his money. It would be better if you filed a civil suit and the two suit are clubbed togather.
