Legal Question in Civil Rights Law in India

My wife Pratibha was born on 11-9-1953 at Tanga Tanzania. She Studied up to 7th Standard and returned to india in 1967. She was minor in that period her father decided not to go back to Tanzania and stayed in India and reengaged in the activity of farming which he was doing prior to going to Tanzania. He had completed required formalities but no proof is available.

Now my wife is denied for Indian passport n the ground that she is not born in India. We got married 08-07-1973. Her mother and father expired so we do not have any proof. We will be pleased if any guidance is received.

Dear Sir

If the father / mother of your wife were residents of India, then under the Citizenship Act, your wife is deemed to be of Indian Origin and citizen of India. She is entitled to get the passport.

Now, what you need to do is to get the birth certificate, or the NATIVITY Certificate of the father / mother of your wife. Once you get the nativity certificate, then based on that you can apply for Indian Passport.

Could you please specify from which state you belong.
