Legal Question in Credit and Debt Law in India

There was a settlement for cheque bounce in court and settlement was signed by me, payee, lawyers of both and by court. In front of honourable judge 2 cheques issued by that person to me .Both cheques were bounced. I sent notices on his residential address but notices returned as the the person is not traceable and notices returned.Through court he was summoned & presented in court. His lawyer is now taking objection on settlement and try to prove the settlement is illegal and in cross examination from start of case. Is it acceptable for court for to start from initial after Settlement. He did not tried for pay from rebouncing of cheques too. Pl advice.

The Court may initiate proceedings afresh if the facts and circumstances of the matter warrant the Court to do so.
