Legal Question in Criminal Law in India
FIR filed against my friend u/ sec 406 IPC, and police is investigating a case, but complainant recovered property involved in case with out permission of Court or Investigation Officer by a person who is named in FIR.
Can this act be treated as ' Out of Court Settlement ' by complainant ?
Can IO file a charge sheet against my friend ?
Can IO classify this case if Complaint is filed on wrong Information by complaint ?
Give case laws if any on such case is available .

406 can be compounded with permission of court and the act does not amount to out of court settlement. for the rest, contact your lawyer.
