Legal Question in Criminal Law in India

One has sexually intercourse by three persons without her consent and against her will in sometime 8 year back. During this 8 years she was shocked and depressed with mental agony, but these people are more power in the field of financial and politically. Hence she could not file a complain at these period. Now she want to file a complain against the offender. Is there time limits and bar the complain to police or court?

In Criminal Law, there is no Limitation prescribed to file a Complaint. One can file compliant at any point of time. Though delay will not hinder the filing of Complaint however, such delay will be fetal on merits of the case i.e. in believing the Statement of the victim. Have to tender satisfactory explanation to the delay in filing the Compliant.

You can file police compliant FIR u/s 154 or private compliant before the Magistrate u/s 200.
