Legal Question in Education Law in India

if a Person as a chairman sits in the panel of interview board, and then he abstains during his brothers turn for interview, is it legal? or there is any ruling on this.

Dear Sir / Madam,

Yes, the Chairman cannot be a party to the appointment of his brother in the organization.
