Legal Question in Family Law in India

Hi,

Myself Kumar and I got married in 2008. We got a baby boy in 2009. My wife is working as a software engineer in an MNC. Unfortunately, we got separated in Dec, 2009. Since then, we are living separately. In 2010 my wife left to USA. My son has been staying with my wife�s parents. Currently I am working in USA. I am not sure if my wife is still in USA or in some other place.

I would like to know, what are my options to get divorced in India? I don�t think my wife/her parents are going to respond to any communication from court.

How long it might take for whole process?

Do I need to be there in India while filing the case? Or someone else from my family can file the case?

Please clarify. Thanks.

in case your wife would not respond to court summons for divorce, you may get ex parte orders within a few months. for filing a petition for divorce, your presence is not required and the same can be filed through your next friend or relative.
