Legal Question in Family Law in India

I am Hindu. Got married at home in 1995 and has no marriage certificate. The marriage has 2 daughters living in hyderabad, India. Due to some differences and doubting my character and degrading my respect with my colleagues I am riled and starting living separately since 5 years and working in India. My wise even hold my passport since than I have requested several times thru my brother and e-mail to return my passport, but she refused. Currently I need to submit my passport for my official assignment and also willing to separate legally. How to proceed further and should get my passport. Please guide me accordingly.

Firstly, serve a pleader notice calling upon her to come forward for a mutual consent divorce and to return the passport. If that does not work, file a contested divorce on grounds best suited to your case. In that, you could move an aplication for a direction to her to return the passport. WE CAN ALSO FILE A CRIMINAL COMPLAINT SEPARATELY FOR THAT PURPOSE.
