Legal Question in Family Law in India

I got married in Dec 2013...I did not want to marry as I loved someone else... Before my marriage I told my husband everything but because of family pressure we had to marry..It has been 4 months and our marriage is non-consumated...both of us want to end this marriage...can my husband file a case of annulment against me??? If yes, on what grounds and how long will it take??

My Dear Client,

In your case,I feel.there is no point in prolonging the matter of divorce, since both your hisbam nd yourslf is not interested in continuing a congualgal life.

So you may file joint petition for divorce and specifically state that it is not consumnated yet. You may contact an Advocate who is usually appearing in the famly court of your area, since you are filing a joint petition, both of you can be represented by a single advocate.

If you need any further clarification feel free to contact on my mobile. 093 8 77 14 15 6.

Usually the divorce matters are posted after a period of 6 months but if you file an additional application the order can be obtained with in 1 to 3 months time.

Only option left is mutual divorce. You cannot go for Annulment.

Otherwise it is a tricky matter and your local expert may help you to get Annulment.

Mere non consummation is not a ground for annulment you need to apply for divorce after completion of one year of marriage.
