Hi, what is the process of separation by mutual consent as per the Indian Christian marriage act for a person in Mumbai. Also will this lead to divorce? Do both parties need an advocate? Or can this be taken to the family court and filed?

You have to make an application for divorce by mutual consent. It takes about 6 months and 15 days for the process. Yes it will lead to divorce. One advocate can file for both. 1) Mutual Consent Divorce in case of Christian Couple is governed by The Divorce Act, 1869, under Section lOA.

2) Christians file for divorce under Section 10 A (1) of the Divorce Act, which lays down that a petition for dissolution of marriage by mutual consent can be presented before a court only after a judicial separation of two years.

3) Better engage separate lawyers to avoid conflict of interest n future problems.
