Legal Question in Civil Litigation in India

Sir, I am proprietor of a clothing company, I have sold goods worth 23 lakhs to one party, he paid 9 lakhs till date, balance is not paying even after selling our product. I belongs to scheduled Cast, can i file case under SC /ST atracity to recover the balance payment??

1) Non-payment of dues arose out of business transaction cannot be an atrocity under SC/ST provisions.

2) U should not invoke such Acts without truth in the complaint.

3) Otherwise it may boom rang on u, which he will show against u when u file civil suit to recover ur dues in court.

4) Discuss with the debtor and through business elders first try to recover and solve the issue. As a last resort file civil suit.

Non Recovery of debt has nothing to do with your cast, whether you are SC ST OBC OR ANY OTHER XYZ Caste. You will be misusing and clearly abusing the law. Heaviest cost will be imposed on you for filing such a bogus compliant. Please respect the law.

Stop misusing the beneficial and protective laws.
