Legal Question in Immigration Law in United States

I have a valid h4 visa, but my I-94 expired 10 months. It expired because it was dated as per my old passport expiry. I renewed my passport but since i was not aware of my i94 date being tied to passport expiry, i missed extending my i94. My h4 is valid for another yr and my spouses h1 is valid for 2 yrs. Is it better for me to leave US ASAP and apply for a new h4 & 3 yr waiver or apply for I-94 extention?
