Legal Question in Employment Law in India

Dear sir, thank you in advance for answering my query.

We are a S/W company from Hyderabad and actually we have updated the notice period policy from 2 months to 3 months. One of our employee has discussed that is not okay with 3 months notice period. However, he has resigned after 3 weeks and he has not mentioned this reason in the resignation email.

He has been relieved on his request from his duties after serving 2 months notice period instead of 3 months. We have paid his salary for the 1st month during NP and 2nd month salary is not paid as he has not served the 3rd month NP and we want to compensate his salary for that.

What will be the consequences for this as the employee is saying that he complain to Department of Labour.

Please assist me in this regard asap.
