Legal Question in Employment Law in India

Dear Sir,

i am working for a bank and my confirmation due date is 18th october 2016 (completing six months) but i have submitted my resignation on 19th October 2016 till date (27th Oct 2016) my reporting manager have not confirmed my service. as per the banks employment rules and employee has to service 30 days if on probation and 90 days if confirmed. now they are threatening me that the will do back dated confirmation and make my notice period as 90 days. I have all screenshot as proof that. will they be able to hold me for 90 days? any legally i can handle it?

1) Follow T&C of employment.

2) Unless probation extended, u r deemed to hv been confirmed.

Dear Sir / Madam,

You have ample evidence that you have resigned from the Bank prior to you being confirmed. The Bank cannot make false claims that you are a confirmed employee. You should amicably serve the 30 days notice period and quit.
