Legal Question in Employment Law in India

I posted the below question and got the below reply.

Question:-

I have resigned my previous organization on 11 December and joined my current company on 12 December without relieving letter since my previous organization was not ready to relieve me in one day but the opportunity that i was getting in my current organization was too good and they were okay without relieve letter.My previous organization gave me relieving letter on 24th December.Is this illegal and will create any problem in future if i am joining any other company?

Reply:-

A relieving letter being just a formality, it's date hardly matters. I do not envisage any issues or problems thereon for you in the future.

I just want to know that I have resigned from my previous organization but they have not accepted and Since from 12 December to 24 December i was on payroll of both the employers so Is this not a case of dual employment?

Dear Sir / Madam,

No, in view of the basic fact that in all likelihood, you would not have received salary from 12.12.2015 till 24.12.2015 from your previous employer, it cannot be construed as "dual employment".
