Legal Question in Employment Law in India

I am an HR of an IT company. We have both trainees and employees working for us under service agreement. My question is,

1) can we make the trainees & employees sign same SLA breaking it in 2 phases-employment & training?

2) Can we ask a trainee compensation if he breaks the agreement or after training does not join the company?

3) How many months of salary we can maximum ask to an employee to compensate if he/she leaves with service level agreement period? Is it possibly to legally contest and claim the money?

4) can you suggest any other legally proven way through which we can ensure retention of the trainees and employees?

Dear Maniratna,

An employment or service bond of any form or nature is illegal and a criminal offence. You can have an award and reward system for employees achieving milestones in the Company.
