Legal Question in Employment Law in India

I joined a reputed company as Sr. Executive - BD in 2014 but for some reasons company had to shut down that department and I willing accepted my transfer to operational department. Now company says there is no work in op. department and transferring almost 60 employees to outbound calling process. I am 50 years of age and this profile does suit me at all and there is no future for me here. Company says those who are not comfortable here can resign with one month notice. I want to resign and seek suitable compensation for the same. Can I fight for it ? In the past some of our senior staff members got 2 months salary under the same circumstances. Please advice me.

1) It depends upon ur T&C of employment and Company Policy.

2) If two months salary is admissible u will get it otherwise not.

Dear Sir / Madam,

You should politely inform the Management of your inability to cope with the new job profile assigned to you and if the Company has a Voluntary Retirement Scheme (VRS), you should opt for it since you will be adequately compensated by it, rather than get just one or two months salary extra only.
