Legal Question in Employment Law in India

Respected Sir/ Mam,

I am working at whitefields overseas limited, faridabad, Haryana as a IT Officer from past 8 months know i want to resign from the current position but the MD of the company is not accepting my resignation i also ready to fulfilling the company policy by serving a notice period of two months but he is refused to accept and the MD of the company is also harassing me and all the staff by literally abusing us and using of bad words in the office premises and also threat me & other that " if any one go against him in any manner he should take a strict legal (criminal/civil) action against him or her" from past two months he is not paying the salary on time if we ask the reason for that he says "do whatever you want, i will pay whenever i want" and neither he is paying for the working done on holidays (national & sundays).

Please advise me what should i do i am really in a very worst condition.

Dear Sir / Madam,

A notice of resignation served by an employee to the Company is binding on the Company. All you need as proof is an acknowledgement of your resignation. If the notice of resignation has been served by email, there is no need of any acknowledgement by the Company Management too. A joint letter of representation may be given signed by all the employees to the MD to preserve office decorum and to behave properly in the Office. As soon as your two month's notice period is over, you should ask the MD for your full and final settlement of your dues. If the MD fails to pay up, simply lodge a Police complaint of "cheating" against the Company in the local Police Station. Forward a copy of your complaint to the Registrar of Companies too for their information and necessary action.
