Legal Question in Employment Law in India

I have served for only 2 months in a reputed company in Pune and resigned for further studies. My contract is silent for any probation period. It also says for 1 month notice period or notice pay if employer terminates or 3 months notice period or notice pay if employee resigns.

Please advice whether just for 2 months serving notice period of 3 month is applicable?

From the day u served notice or resignation, 3 months notice or pay salary in lieu of notice.

Dear Dharmendra,

You will have to serve one month's notice period or else pay the Company one month's salary (basic pay only) if you are not serving the notice period.
