Legal Question in Real Estate Law in India

dear sir, My grandfathers had divided there property. Due to my grandfather inefficiency he got 440sq yrds and other two grandfathers got much more. There is a common road which was left for walking and vehicles purpose after dividing the land. But there are no written papers on this. Now one grandfather who is alive and his sons are saying that land(Walk way) belongs to them and under division it is allotted to them. Now what can we do to keep that land as walk way. Please suggest.
