Legal Question in Real Estate Law in India

My Father passed away in 2006 , My Brother and I are both staying in Dubai.
My father used to visit dubai and often used to stay with him as he had a 2BHK flat in dubai.
Now after his passing away my brother says i have no right in the property nor the flat as Dad used to stay with him.He kept lingering and even the society has changed the flat in his name without proper documentation.
The Bldg has gone in redevelopment and should be ready in the next few months. What rights do i have left to demand my rights as my brother had agreed in writing (email) that I will take the Flat and he will take the rest of the property which he went back on.
The society are hand in glove with my brother as they did not want the redevelopment should be hindered.
