A judge must decide whether a defendants's blood alchol level of .08 at the time of an accidet to decide whether the driver was impaired or intoxicated, is this a question of fact or law or both?

That the judge is the fact finder in a bench trial is a matter of law. The BAC of a defendant is a matter of fact.
