Legal Question in Family Law in Alabama

Removing father's name from birth certificate

How can I have the father's name from my daughter's birth certificate and any other birth records. If he is willing to sign away his paternal rights, do we still have to go to court?

Removing Father's Name From Birth Certificate

You are going to need a court order to change the name on the birth certificate, OR to terminate his parental rights... and Tennessee courts will not terminate him as father until or unless there is another father in the wings to adopt. Part of this is because if the father is not there to contribute to the financial support of the child, the state often does so.... and if the state contributes, then it will go after him to essentially get reimbursed. So the state does not even allow him to simly sign away his rights and also avoid his responsibilities.
