Statute of Limitiations

An original contract has been breached and the statute of limitations will expire in 2 weeks. The ''defendant'' has asked me to write a new contract to allow a few more months to pay his debt. If he defaults on the ''new contract'' do I have standing to sue and will the statute of limitations extend from the ''new contract''? Thank you

To answer your question: if the statute of limitations is missed, then you cannot enforce the original contract after that date. If you write a new contract, then that new contract will be enforceable until the new statute of limitations period.
