Legal Question in Wills and Trusts in Alabama

If my dad died in 2005 and he had no will do i still get a share of the estate? If i do can i start fixin up the land to move out on it?

It depends. If there was no will, then an estate has to be opened. Unless the land has to be sold to pay the bills of his estate, then you have to look to who else might inherit. Was he married to your mother when he died? Is she still alive. Was he married to a woman who is not your mother when he died? Is she still alive? Do you have any brothers or sisters? You may also be able to take title to the land with heirship affidavits rather than having to open an estate. You should do see a lawyer about this.
