Legal Question in Family Law in Arizona

court ordered garnishment

Is there anything that can be done against an employer that has received a court ordered garnishment for child support against one of their employees and they do not send out the payment, in a timely manner? If they take the money out during the previous month,is there a set time when the payment should be sent? What can the person that is to receive the check do?

Re: court ordered garnishment

The most important thing is not to impune supernatural powers to your spouse like imagining that he has the power to make his employer violate a court order. You may be sure the employer wants to obey so be understanding and help the employer. This will be the quickest, best way to get your money. Don't get crazy. The employer is probably just trying to comply with the court order and afraid he doesn't know quite how to handle the records.

I strongly suggest you be very courteous and diplomatic in spite of the fact that you are probably fearful because you do not have your money. Send a copy of the court order (I know they already have one but internal departments get confused) with a nice letter explaining that you really need the money to support your family and ask them to expedite the order. Then follow up with a nice phone call and if you have to, start working your way up the corporate ladder. The whole enterprise should not take more than a week. The last resort would be to get an attorney.
