While filing for a divorce, is my spouse legally obligated to continue paying our mutual bills that we acquired during the marriage such as mortgage, insurance, utilities, etc?

Once a divorce if filed/served, NO CHANGES can be made to insurance. However, there is no "automatic"order that requires those expenses to be paid.

You are able to file a request for temporary orders, which is the quickest manner to get in front of a Judge. You can ask then that the Court allocate monthly expenses in an appropriate manner.

We can certainly help you consider and then pursue your options in your ongoing manner. This is obviously a very important matter, and you should not go in alone.

One of our attorneys can explain the issues and procedures better in person. As you can imagine, there is too much to cover via email. We offer free 1/2 hour consultations, in which we can discuss your matter in detail.

Please call us directly to discuss the specifics of your matter, or contact my assistant Alicia or my paralegal Jennifer to schedule your free 1/2 hour consultation.
