Legal Question in Civil Litigation in Arizona

Fire damage liabiliy

My neighbors garage caught fire, cause unknown. Spread to

my house, causing serious damage to the house and personal

property.My insurance covered the majority of the damage,

except for approximately $6500.00 of personal property.

Is my neighbor responsible for the damage? He had no insur-ance coverage. If he is resposible and we are not able to work something out, do I have grounds for a lawsuit that

would likely go in my favor? If so what is the limition of time to initiate the lawsuit? Thank you for any help and or

suggestions.

Liability in such situations is based upon tort or negligence law, and whether or not one can recover in litigation under the facts you present depends upon whether or not the neighbor was negligent in causing the fire or permitting it to occur through some action or inaction.

If you can prove the neighbor was intentionally or negligently responsible for the fire, then you should be able to obtain a judgment for your proveable economic [unisured] loss.
