Legal Question in Immigration Law in Arizona

ok so here it goes...my fiance was brought to the U.S when he was 3 years old by his parents. He lived in small town his whole life and even graduated from our local high school. He had gotten in trouble for a hindering charge and got voluntarely deported. He lived in Mexico for about 6 months after that...but here is the thing he does not know how to read or write spanish and can not speak it properly, he has no family or friends in mexico. The only uncle he had, had gotten killed by a local gang. He was scared and living on the streets. So he came back to the U.S illegaly,in which i had met him and now been with him for about 4 years. He went to court for his hindering charge and it was dropped down to a misdemeanor and was only going to have probabation, but ICE came and got him at his last court date. So he was in jail waiting for his immigration lawyer to come talk to him, but they deported him again before the lawyer got there. Now im pregnant with his child, and still wanting to get married to him. He still has no place to stay in mexico and still in fear for his life. Is there anything we can do to get him any kind of Visa or waiver so that he can come to the U.S to help me raise our child?

I am very sorry to hear about your situation. Unfortunately, I don't think that it's possible for him to come back after second deportation and previous illegal entry after removal.

Form the point of view of American immigration law, it doesn't matter that he can't speak or write Spanish or that his fiancee is pregnant. What is the most important (from legal point of view) is the fact that he was deported and came back to U.S. illegally after deportation, after that he was arrested and the previous deportation order was 'reinstated', as I understand. This is why they didn't have to wait for a "lawyer to get there".

I suggest you talk to a qualified lawyer about your options before starting any immigration process on his behalf.
