What is the best process for petitioning an immigrant for labor certification?

In what respect?

For a PERM case, the U.S. employer needs to meet all the USDOL requirements. If/when the PERM case is approved, the U.S. employer files the I-140 petition. Depending on the employment-based category, there could be a waiting period before the foreign worker can apply for an immigrant visa. If the foreign worker is in the United States, they must maintain valid, non-immigrant visa status the entire time, up until the time they file for Adjustment of Status.
