Legal Question in Juvenile Dependency in Arizona

School board suspension hearing

on 3/31/09 my 12 yr old son was involved in the event that follows as explained by the VP of his school: During lunch on 3/31/09, a student reported to security that the boys' bathroom smelled like marijuana, and that Stone and another boy were smoking maijuana in the bathroom. The two boys were found and escorted to the office. Stone was told of the accusation and immediatly admitted that that they were smoking together in the bathroom. stone said he took the mj to the bathroom & asked the other boy if he wanted to smoke some. Stone was searched (not by an officer and without parent present) and nothing was found. he said he flushed down the toilet and that he found it in class. Upon further investigation, another student said that Stone showed it to him and asked him if he wanted to buy some. '' I realize he admitted to his stupidity but is there any advice or argument for me to keep him in school? he already had 9 days suspension. I think kicking him out would be a negative influence on my ability to punish him myself for his actions. I don't want him to fail 7th grade and he is ashamed and embarrassed already. I can have counsel but can't afford it. I feel helpless. I do want him to suffer punishment for his actions but I fee

This is a troublesome situation in which you will find that the school has a lot of discretion. Maybe you can negotiate something with the folks at school short of drastic outcome.
