Legal Question in Medical Leave in Arkansas

My husband and I work at the same work place. When our baby is due in April of 2009, will we both get 12 weeks leave or will we have to share the 12 weeks?

You each get 12 weeks of leave if the company is covered by the FMLA and you qualify for the leave. You could take your leave at the same time or at different times. Depending on your company's circumstances if it is a hardship for both of you to be gone at the same time, then they may be able to structure when you could both be off at the same time. If you feel you are being treated unfairly then you should consult an attorney.
