Legal Question in Wills and Trusts in Arkansas

My husbands father passed away April 2013. The executor/attorney is father's brother in law with financial problems owing the state of Arkansas $12K. House sold as cash deal June 30, 2014. My husband has been asking for an accounting for over a year and the executor refuses to do so.......even after the judge ordered him to April 2014 estate hearing. He now wants my husband to waive his rights to an accounting and if he doesn't the executor said it will delay the final distribution possibly into 2015. Another estate hearing is set August 28th. Should he just wait for the hearing to see the accounting? Should he ask for an immediate removal and surcharge? We believe this executor/attorney cashed in all mutual funds, investments months ago and is collecting interest. We are in California so it's a little difficult.

You need to hire an Arkansas attorney to represent your interests in the probate. Once an attorney is hired he or she can look into the matter and give you a much better idea of what your remedies are. Letting this go to long could create the typical no win situation: You can sue and win, but all the money is gone and you can't get the money back.
