Legal Question in Bankruptcy in California

I am 71, unemployed, living in orange county, calif. I own a mobile home that was inherited by me. It is worth approx. 160K free and clear. I drive a paid for car altho it is a 1992 Mercedes. I owned my own business for 30 years as an interior designer but lost my clients when I moved to another city and then I lost 2 homes I bought in this other city, one to short sale and the other "cash for keys" and the bank gave me $1000. and took over the house. This was all in 2009.

I owe 15K in cr card debt which I cannot afford to pay now and have not charged on these for over a year and made "deals" w/3 of them to pay 51.00, 35.00 and 15.00 BUT HERE IS THE PROBLEM. I have to live on SS at $852./mo. so really cannot afford to pay these cr cards at all.

My HOA and utilities, add up to about $550. and then there is food and gas so 852. doesn't go far enough to pay these cr cards.

I have no retirement, no IRA, no savings and about 200.00 in my checking account. I can't put my mobile up for sale as this is the only place I can live with the HOA, water, cable and gas adding up to only 250.!

MY QUESTION: CAN I FILE BANKRUPTCY MYSELF AS NOT ENOUGH FOR AN ATTORNEY FEE.

WILL I LOSE MY MOBILE HOME AND/OR MY CAR? SHOULD I HOMESTEAD MY MOBILE?

SHOULD I BE ABLE TO SCRAPE UP SOME $$ FOR A BANKRUPTCY ATTY HOW MUCH WOULD THAT BE AND DOES AN ATTY TAKE MONTHLY PAYMENTS FOR A CERTAIN AMT OF TIME?

HELP! Thanks.

It's recommended to seek legal counsel.

My office in San Diego accepts flexible installment plans, however you would need to contact a local attorney in the O.C.

Good luck, we hope it works out for you.

Yes, you can file chapter 7 bankruptcy and more than likely still be able to keep your mobile home and other assets. I would not recommend you to do your case by yourself since your situation has many assets that need to be reported properly.

I am a Bankruptcy attorney in Orange County, CA. Our office accepts payment plan. Please contact us so we can help you.
