merit increases and cost of living raise

I was on disbility do to a incident on my job for the months that I was off on disbility they gave me a one penny merit increase in pay now that I AM BACK TO WORK MY SUPERVISOR STATED I WAS LUCKY TO GET THE PENNY CAN THEY DO THAT I still have not recieved my performance evaluation.

Employers cannot use disabilities as a basis for making personnel decisions. Whether that was done in your case is a question of fact. If you believe you were discriminated against because of a disability, make a formal complaint with the company using their EEO policies. If you still are not satisfied, consult with an experienced employment law attorney to review the facts of your case.

Bear in mind there is a one year time limit to file discrimination claims with the state of California.
