Legal Question in Disability Law in California

hello , i work for bank of america as security however i am disabled due to many medical conditions. i parked in tbe handicap parking and put my handicap placard up ,and on december 24th 2010 the branch manager told my captain that im not allowed to park in the handicap parking its for the customers . my ququestion is due i have any legal recourse? and are they allowed to do that even though im an employee?

Employers are required to reasonably accommodate employees with disabilities, as long as the accommodation does not cause an undue hardship on the company. However, there is also a requirement that businesses provide a certain number of handicapped parking for the public and employee use of handicap parking may impose potential liability under the ADA.

You should try to set up a meeting with bank management, bringing in a human resource manager, as well, to discuss what can be done to accommodate your disability in a way that will not create ADA violations. Perhaps designated parking spaces can be set aside for this purpose. In any event, you and your employer should engage in an interactive dialogue to attempt to resolve the issue.
