Legal Question in Bankruptcy in California

Collection Agency Question

I was a minor when a bank account was opened with my name and my mothers. I have not used this account in years I thought it was closed, I have received a notice this account has been turned over to a collection agency for things my mother did. Am I responsible, how should I proceed. I am only 19 and trying to go to school and am taking care of myself and I do not live with my mother.

Re: Collection Agency Question

You cannot be responsible for repayment of whatever it is they are attempting to collect from you. Advise them that you were a minor when the account was opened (thus, could not be legally bound by the terms of the account agreement) and when the events that took place creating liability occurred and that they need to stop attempting to collect the debt from you. If they refuse to back off, you need to speak to a lawyer in your area.
