Legal Question in Bankruptcy in California

I left full payment for a Bankruptcy with an attorney and my situation changed where I can't file Bankruptcy. His office won't give my money back. What do I do?

It depends. Did you agree to a non-refundable retainer? Did the attorney begin working on the bankruptcy? If you didn't agree to a non-refundable retainer and the attorney did no work for you and will not return your retainer payment, you can file a complaint with the California Bar Association, or sue the attorney in small claims court.

What changed? Why can't you file BK?

If you simply don't qualify for Chapter 7 ... Chapter 13 is not the end of the world. Ask the attorney to apply the fees to a Chapter 13.
