Legal Question in Business Law in California

I am employed as a Network Technician, I work under other Network Engineers. They hired me as salary. I am being told now that my job clasifacation does not meet salary test and they are switching me to hourly. I am going to loose a whole paycheck now because I have to have a paycheck in arears. Ouch, but what of all the overtime I worked while being misclasified as Salaried? I am in Roseville California and Live in Pollock Pines CA.

The answer would depend upon whether your reclassification was retroactive or not. I don't know the answer, but I suspect that it would not be retroactive. If so, you became an hourly employee at the time you were notified of the same, and not from the date of first employment. As I say, this is my hunch, based on the way things like this seem to be interpreted. For a better response, I suggest you might contact an office of the employment commission.
