If you are an employee you can go through the labor board first. If you are not an employee, then you will need to file a lawsuit. Sounds like this is not a simple, straight-forward employee who has not gotten paid for work performed.

After that, you could file suit if you've already reached a dead end with the company. That assumes you don't intend to continue working without pay for them, and assumes they have the money to pay you anything. If they are insolvent, meaning they have nothing, then nothing is what you're going to get from suit or negotiations.
