Legal Question in Business Law in California

Final Warning/Termination

I have just had my annual review and it turned out to be a final warning, where I was offered the option of quitting with two weeks ''severence'' or returning on the conditions that I have no more warnings and can be terminated at any time. My question is, since I have never had any other formal warnings, is this legal?

"Legal?" Yes.

Unless you are covered by a written employment agreement or a union contract, you are 'at will', meaning you can be fired anytime for any reason, unless it violates the discrimination, whistleblower or other specific statutes.

Re: Final Warning/Termination

Hello. This depends on (1) the formal policies of your company (usually outlined in the handbook) and the terms of your employment (are you at will employee, contractor, a union member?)

If you would like to discuss this further, feel free to follow up.
