Legal Question in Business Law in California

We recently rented heavy construction equipment from a rental dealer. We have always carried our own damage waiver insurances and always provide a certificate to the Dealer stating such. Dealer failed to give us the option to provide the certificate and charged us 10% on cost to use their insurance. The cost would have been avoided had we provide them with the certificate that we had possesion of. Tyhe total amonunt of additional insurance cost to us was $8,000.00+. Dealer is refusing to refund the insurance cost due to the fact that they did not have thecertificate on their file. I have the certificate naming the dealer as additional insured for the time/dates the equipment was rented. Dealer is say 'too bad' and are not refunding money. We are in California.

The dealer is right. If they did not have it in their file, they were at risk and insured accordingly. They are not obligated to give you the option to self insure, that is their choice.
