Legal Question in Civil Rights Law in California

help

My cousin met this guy who said he was 18 and she was 19 at the time..she got pregnant then he told her he was 14!!! she had the baby his mom found out and they arressted her..what rights does she have? they have her on 440,000.00 bail. how can she defend herself? they took her baby and put her in foster care. does she have any rights to her child? can her mother get her child? she got arrested on 5/7/2009

she thought a 14 year old was really 18? That doesn't work for guys usually and will be a tough sell for her as well. The public defender will assist on the rape charge.
