Legal Question in Technology Law in California

AOL Leaks User Information, restitution

Dear Sir/Madam:

I am an American citizen working in Asia (Thailand). I have recently heard about AOL's ''leaking'' of user information against its privacy policy agreement. I am appalled. Is there anything one can do to raise issue and claim damages against this action?

I look forward to hearing from you.

Regards,

Re: AOL Leaks User Information, restitution

I think that in theory there are two possible approaches to this; I don't express an opinion on whether either is practical:

First, if you have actual damages, you can sue AOL for those damages based upon breach of contract. Unless the damages you can prove are quite high, this may not be economical. You would need to confer with one or more law firms who have active litigation practices against big companies. You (or such lawyers) might be able to locate court files for similar cases to see whether there were settlements, or who won.

The other possibility is to hunt for a class action already under way or planned, and contact the law firm representing, or planning to represent, the class. Such law firms often have Web sites that discuss the planned cases, with a view to locating potential class members. If you were to use various search engines and terms such as class action, AOL and privacy, you might find one or more. Read everything carefully before deciding to participate. This approach would probably work better if you cannot prove substantial economic harm done to you.
