Legal Question in Construction Law in California

drainage around pool

We had an inground pool built and we're having a problem obtaining proper drainage for the runoff from the gutters and drains installed in the concrete decks. Who is responsible for providing the drainage? Nothing is stated in the contract - is it our or the pool company's responsibility?

It is clearly to me the party who is most expert in both designing, placing and constructing the pool. If you interfered with the pool company and made them placed the pool in a position different from that which they originally suggested or had drawings made then you may be responsible. If though you gave them free rein it seems to may that they are fully responsible for any damage by way of drainage or lack thereof and should come back and correct the problem.I have been practicing law in the San Francisco Bay area for approximately 35 years and expert in the area in the category in which your question is placed.
