Legal Question in Consumer Law in California

debt

I paid a legal bill by a debit card but the request for payment was never made to my bank. Further payments went through. Now I have been threatened with debt recovery; where do I stand?

Re: debt

If you the request for payment never went through, that must mean you never paid the bill. It sounds like you owe the money and should pay it unless you dispute the amount owed for some reason.

Let's say that you had our car repaired and paid by check and the check was lost or destroyed. You would issue replacement check if requested by the mechanic, wouldn't you? It might not be your fault that the check was lost or destroyed, but you need to pay for the services if the money that you owed never left yor account.

Re: debt

If the payment was not made then you still owe the money. You can either pay it or be sent to collections.
